Article 2 - Applicability

These general terms and conditions apply to every offer from Bukowskiknuffels and to every distance contract concluded between Bukowskiknuffels and the customer.

Before a distance contract is concluded, the text of these general terms and conditions will be made available to the customer. If this is not reasonably possible, it will be indicated where the general terms and conditions can be inspected. They will be sent free of charge upon request.

Deviations from and additions to these general terms and conditions are only valid if agreed in writing.

 

Article 3 - The offer

Every offer is without obligation. Bukowskiknuffels has the right to change or withdraw the offer.

The offer contains a clear description of the products offered. The description is sufficiently detailed to allow a proper assessment by the customer. Images with the offer are a true representation of the products offered. Obvious mistakes or errors in the offer do not bind Bukowskiknuffels.

Each offer states, where applicable: the price including VAT, any shipping costs, and the manner in which the agreement will be concluded.

 

Article 4 - The agreement

The agreement is concluded at the moment the customer accepts the offer and the stipulated conditions have been met.

Bukowskiknuffels will confirm receipt of the acceptance as soon as possible by electronic means. As long as receipt has not been confirmed, the customer can dissolve the agreement.

Bukowskiknuffels may ascertain whether the customer can meet their payment obligations, as well as all facts and factors that are important for a responsible conclusion of the distance contract. If Bukowskiknuffels has good reasons not to enter into the agreement based on this investigation, it has the right to refuse an order or request or to attach special conditions to its execution.

 

Article 5 - Right of withdrawal

The customer has the right to dissolve the agreement without stating reasons within 14 days after the day of receipt of the product.

During the cooling-off period, the customer will handle the product and its packaging with care. The customer will only unpack or use the product to the extent necessary to determine its nature, characteristics and functioning. The basic principle is that the customer may only handle and inspect the product as he would be allowed to do in a physical store.

If the customer exercises their right of withdrawal, they must report this within the cooling-off period via info@bukowskiknuffels.nl. Bukowskiknuffels will confirm receipt of this notification.

The customer will return the product as soon as possible, but no later than 14 days after the notification. The direct costs of returning the product are for the account of the customer, unless otherwise stated.

Bukowskiknuffels will reimburse all payments from the customer, including delivery costs (with the exception of any additional costs due to a choice of delivery method other than the cheapest standard delivery), as soon as possible, but no later than 14 days after the day of receipt of the returned product.

 

Article 6 - Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

-       products manufactured by Bukowskiknuffels based on customer specifications, not prefabricated, and manufactured based on an individual choice or decision of the customer;

-       products that are clearly personal in nature.

 

Article 7 - The price

Prices are in euros, including VAT, unless otherwise stated.

Shipping costs are not included in the price and will be stated separately before completing the order.

During the validity period of the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates.

 

Article 8 - Payment

The customer will pay the amounts due using the payment methods offered in the webshop.

The customer is obliged to immediately report inaccuracies in provided or stated payment details to Bukowskiknuffels.

In case of late payment, the customer, after having been informed of the arrears and given a period of 14 days to still pay, owes the statutory interest on the outstanding amount.

 

Article 9 - Delivery and execution

Bukowskiknuffels will observe the greatest possible care when receiving orders.

The place of delivery is the address that the customer has made known to Bukowskiknuffels.

Orders will be executed as quickly as possible, but in any case within 30 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be executed or can only be executed partially, the customer will be informed of this. In that case, the customer has the right to dissolve the agreement free of charge.

After dissolution in accordance with the previous paragraph, Bukowskiknuffels will refund the paid amount as soon as possible, but no later than 14 days.

The risk of damage and/or loss of products rests with Bukowskiknuffels until the moment of delivery, unless expressly agreed otherwise.

 

Article 10 - Warranty and conformity

Bukowskiknuffels guarantees that the products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness and usability.

A warranty provided by Bukowskiknuffels does not affect the legal rights that the customer has under the law.

In case of complaints about a product, the customer should contact Bukowskiknuffels as soon as possible via info@bukowskiknuffels.nl.

 

Article 11 - Complaints

Complaints about the execution of the agreement must be submitted to Bukowskiknuffels as soon as possible, fully and clearly described, after the customer has discovered the defects.

Complaints submitted to Bukowskiknuffels will be answered within 14 days from the date of receipt. If a complaint requires a longer processing time, the customer will receive an acknowledgment of receipt within 14 days and an indication of when a more detailed answer can be expected.

If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.

 

Article 12 - Disputes

Agreements between Bukowskiknuffels and the customer to which these general terms and conditions apply are exclusively governed by Dutch law.

Disputes can be submitted by the customer to the competent court in the district where Bukowskiknuffels is established, or to the Disputes Committee (www.sgc.nl).

 

Article 13 - Privacy

Bukowskiknuffels processes personal data of the customer exclusively for the execution of the agreement and the processing of the order. Bukowskiknuffels handles personal data with care and complies with the General Data Protection Regulation (GDPR).

Article 14 - Amendment of terms

Bukowskiknuffels reserves the right to amend or supplement these general terms and conditions.

Changes will be announced in a timely manner before they take effect. If the customer continues to use the webshop after the effective date, they accept the amended terms.
